Terms of Service

These Terms of Service (“Terms”) govern your use of itakda (“the service”, “we”, “us”). By creating an account you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

1. Agreement

Your registration and continued use of itakda constitutes acceptance of these Terms. We may update them from time to time as described in Section 12.

2. Beta status

itakda is currently offered as a free beta. The service is under active development; features may change, break, or be removed, and data may be lost. There is no service-level agreement and no guaranteed uptime during the beta. Use the service with this in mind, and keep your own backups of information you cannot afford to lose.

3. Eligibility

You must be at least 16 years old to use itakda. By registering you confirm that you meet this requirement.

4. Your account

  • One account per person. Do not share your credentials.
  • You are responsible for keeping your password secure and for everything done through your account.

5. Acceptable use

You agree not to:

  • Use the service for anything illegal or to harm others
  • Store personal data about third parties that you do not have a lawful basis to process
  • Upload malware or attempt to compromise the service, its infrastructure, or other users
  • Scrape, reverse-engineer, or resell the service
  • Use automated means to create accounts or generate excessive load

6. Your content

You retain full ownership of the projects, events, deliverables, contacts, files, and other content you enter into itakda (“Your Content”). You grant us a limited, non-exclusive license to store, process, and display Your Content to you solely for the purpose of operating the service.

7. Third-party personal data

If you enter personal data about other people (clients, vendors, crew), you confirm that you have a lawful basis under the Philippine Data Privacy Act (RA 10173) to do so, and that you are acting as the data controller for that information. We process it only on your behalf. You agree to inform those individuals, where required by law, that their data is stored in itakda and to honor any rights they exercise directly with you.

8. Termination

You may delete your account at any time from your profile. We may suspend or terminate accounts that violate these Terms or that create risk for other users or the service. Where possible we will give notice first; in cases of active abuse we may act immediately.

9. Disclaimer

The service is provided “as is” and “as available” during the beta. We make no warranties, express or implied, about reliability, fitness for a particular purpose, or non-infringement. Your use of the service is at your own risk.

10. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the service is limited to the amount you have paid us in the twelve months preceding the claim. During the free beta, this amount is zero. We are not liable for indirect, incidental, or consequential damages, or for loss of data or profits.

11. Governing law

These Terms are governed by the laws of the Republic of the Philippines. Any dispute not resolved informally will be submitted to the courts of the Philippines.

12. Changes

We may revise these Terms as the service evolves. When we make material changes we will update the effective date at the top of this page and notify registered users by email. Your continued use of the service after the effective date means you accept the revised Terms.
